1. The contract between us
Access to the free version of the Welbee toolkit is provided free of charge. The content within the free version of the toolkit may change at any time.
For paid individual memberships, must receive payment at the time of subscription. If your subscription lapses, you will lose access to the premium content at the end of your current subscription term.
For paid school memberships, must receive payment within 30 days of any invoice agreed between us. We may grant you access to our services prior to payment as long as you provide us with either a purchase order number or confirmation of your commitment to make the payment.
it is not possible for us to obtain full payment then we may cancel the contract and suspend any further use of any of our services, resources or materials. This does not affect any other rights we may have. We do not share any customer details with any 3rd parties.
2. Copyright
All materials provided by us are our copyright as detailed on information provided. If you amend or change any materials, these will remain under our copyright. You cannot claim them as your own or distribute them, whether privately or commercially, without permission.
You must not share, circulate or upload any of these materials with anyone outside your school, trust or organisation, unless with our permission. It you are a school member, it is your responsibility to ensure all employees who use our materials and services are aware of and abide by this requirement.
3. Accuracy of content
We have taken care in the preparation of the content of this website, and any other information we provide, to ensure that information quoted is correct at the time of publishing.
4. Damage to your computer
We try to ensure that this website and our applications are free from viruses or defects. However, we cannot guarantee that your use of this website or our applications, or any websites accessible through them will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available, for example virus protection and firewalls.
5. Pricing & Delivery
Products and services are priced as shown on the website (where applicable) and through any other offers we may make from time to time. We also offer a full guarantee to first time users of our welbee survey.
6. Acknowledgement and acceptance of your order
You will need to provide us with your name and email address, and we may request your school or physical address. You will be notified by email to confirm receipt of your order, once made.
7. Notices
All notices to us must be in writing and sent to us at 440 Outwood Common Road, Billericay, Essex, CM11 1ET (temporary during the pandemic and until this is updated). Our registered address is Studio N, 44 Simpson Street, Liverpool L1 0AX. All notices from us to you will be through direct contact.

We reserve the right to change these terms and conditions from time to time and you should look through them whenever you visit the site or transact with us.
9. Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website or any of our services, are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.

Personal or Employee information
This is where you provide us with personal or employee information to allow us to provide access to the toolkit.
For school subscriptions, when you provide us with employee information, it is your responsibility to ensure that you have employee consent to provide this to us. The lawful basis for collecting this information is to perform a contract with you.
We may also collect information directly from employees. Where you are an employee and we do this, we may collect information regarding your job role, start date, age, employment type, department information and details of your line manager. This is in order to provide our service to you (a survey) and to allow you to participate. You do not have to provide this information, but we cannot provide the survey without it.
More specifically, we collect the following information:
Information provided by individuals, employers and employees is used to provide access to the toolkit.
We share product information with clients and users, including new features and benefits. We ask clients to share feedback on how we might improve our products and services and may also use information to effectively manage any questions or complaints.
We do not collect any Sensitive Data about you. Sensitive Data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.
When you provide us with this information and when we collect it from employees themselves on your behalf, we are the data processor and you are the data controller.
Other information we collect:
Identity: This includes first name, surname, username, title, date of birth and gender. We use this information to allow us to provide our products or services to you, and to enable you to create an account on our site. Our lawful basis for collecting this information is to perform a contract with you.
Contact information: This includes your e-mail address, phone number, delivery address and billing address or school address. We use this information to allow us to contact you regarding your purchase of our products or services. Our lawful basis for collecting this information is to perform a contract with you.
Financial: This includes your bank account and payment card details. This is ordinarily not collected by us, as we routinely collect financial details of businesses/schools only. However, on occasion, we may collect financial details of individuals, where an individual’s payment card is used to make a purchase. Regardless, we use a third party payment processor, who will process your payment details in accordance with their privacy policy. We do not capture or store this information.
Transaction: This may include details about payments between us and other details of purchases made by you. As above, this normally relates to transactions of businesses/schools, but on occasion, there may be transactions that pertain to individuals. We collect this information in order to keep track of payments and our contractual obligations to you. Our lawful basis for doing so is our legitimate interest to ensure we are satisfying our contractual obligations with our clients.
Technical: This may include your login data, usage of our site, internet protocol (IP) addresses, browser type and version, browser plug-in types and versions, time zone setting and location, operating system and platform and other technology on the devices you use to access this site. This information is aggregated, and does not identify you personally. We use this information to improve our website experience. Marketing and Communications: This includes your email address and preferences in receiving marketing communications, or information regarding competitions, prize draws, promotions or surveys, from us and our third parties.
